When Does EB-3 Downgrade Make Sense?

Historically, there have been periods where EB-3 dates moved faster than EB-2, especially for India. In those windows, some applicants "downgrade" from EB-2 to EB-3 to get an earlier Final Action Date. However, this requires:

  • A new PERM labor certification filed under EB-3 requirements
  • A new I-140 petition
  • Your employer's willingness to sponsor again

The strategy is risky because dates can reverse — what seems faster today might not be in 2 years.

Many applicants file both EB-2 and EB-3 petitions simultaneously and use whichever becomes current first. This is the safest hedge if your employer supports it, but it means going through PERM and I-140 twice.
